Is a Telemedicine Sick Leave Certificate Legal? What the Law Says

With telemedicine becoming an integral part of healthcare in India, patients can consult doctors from the comfort of their homes. But is a sick leave certificate issued via a telemedicine consultation fully legal? Let's check the regulations.

Legality Under the Telemedicine Practice Guidelines, 2020

The Telemedicine Practice Guidelines, issued by the Board of Governors in supersession of the Medical Council of India (MCI) and incorporated into National Medical Commission (NMC) regulations, provide the legal framework. These guidelines state that a consultation conducted via video, audio, or text chat is a legally valid medical interaction.

Just as a doctor can conduct a clinical evaluation during a teleconsultation, they are also legally permitted to issue a medical certificate. The law treats a digital certificate issued after a valid teleconsultation exactly the same as a physical certificate signed in a clinic.

The RMP's Professional Responsibility

- Patient Identification: The doctor must verify the patient's identity (e.g., via name, age, address, or ID card).

- Clinical Assessment: The doctor must take a history of the illness and perform a clinical review of the symptoms. For severe symptoms, the doctor may recommend a video consultation or advise the patient to visit a physical clinic.

- Clinical Record Keeping: The doctor must maintain a digital record of the consultation, the diagnosis, and the issued certificate.

The Difference Between Legal Telemedicine and Fake Certificates

It is crucial to differentiate between legal telemedicine platforms and fraudulent websites. Legal platforms facilitate a real consultation between you and a licensed doctor. Fraudulent websites offer 'instant download' certificates using automated bots without any medical consultation or review. The latter are illegal and constitute forgery, whereas a genuine telemedicine sick leave certificate is 100% legal.
